If the exclusion requirement is attached to an interim care order it will cease to have effect if the LA accommodates the child in a placement away from home for more than 24 hours.
Exclusion order family law. Under s 38A 5 and s 44A 5 of the Children Act 1989 the court may attach a power of arrest to an exclusion requirement included in an interim care order or an emergency protection order. An Exclusion order can be made whether you are married or simply cohabiting. It can prohibit the violent person from living in the home of the protected person. The DEO does not affect or transfer the title or ownership of the house.
Neither the applicant nor the other party have to be living in the property at the time the application for an exclusion order is made. The court can make an Exclusion order which forces one party to a relationship to stay away from home. Various ancillary orders may be made including regulating contact payment of rent or mortgage safeguarding the possessions of the excluded person section 61 Children Guernsey and Alderney Law 2008.
What is an Exclusion Order. A person can apply to court for an exclusion order which can suspend the rights of a persons spouse civil partner or in certain circumstances cohabitant from living in the family home. An exclusion order can last for a maximum of 1 year.
The judge determined that the court could make such an order from its inherent jurisdiction and pursuant to the s42 Family Law Act 1996 Non-Molestation Orders FLA and that an exclusion order could be made notwithstanding the absence of such a specific provision within. An exclusion order allows you to remain at home as part of an Apprehended Domestic Violence Order ADVO and excludes or removes the violent person. Means an exclusion order or a provisional family exclusion order made by the Council under this Part.
This was presumably requested by the local authority to protect the children from the risk posed by the father without the need to remove them from the mothers care. If it is made without giving notice to the excluded person it can only be in place for 5 days. A recent case at the Central Family Court involved a 12-month Supervision Order imposed with a provision excluding the father from the family home until further order.
